Sanctions avoided by act of mercy

The only trial court record we needed to decide this appeal consists of: (1) plaintiff’s second amended complaint; (2) the respective demurrers of the Judicial Branch Defendants and the County Defendants with supporting points and authorities; (3) plaintiff’s response to those demurrers with his points and authorities; and (4) the court’s ruling. We considered imposing sanctions for plaintiff’s massive over designation of the record under California Rules of Court, rule 8.276(a)(2) for his conduct of “[i]ncluding in the record any matter not reasonably material to the appeal’s determination.” In an act of mercy, we decline to do so."
