Begging for appellate sanctions?

Second, check out this unpub'd decision in mLogica, Inc. v. Karan, which is 100% Beds all the way through. Here, the appellant has "misstated the record in numerous particulars, a shown in a respondents' brief so devastating that it has left Karan [appellant], like Job, with no reply but silence and a hand over his mouth." Thanks to respondents' "commendable forebearance, there has been no request for sanctions in this appeal" -- but it seems like such a request very well might have been granted.
