2013 Exemplary Legal Writing Awards

The "luminaries and sages" (their words) on the board of advisers for The Green Bag Almanac & Reader have announced their honorees for exemplary legal writing in 2013 and this year's representative from the Southern California appellate community is .... the 9th Circuit's Milan D. Smith Jr. for this dissental (dissent from the denial of rehearing en banc) in Lane v. Facebook, Inc. 709 F.3d 791 (9th Cir. 2013) ("I regret the muddle this case makes of our cy pres jurisprudence, and I respectfully dissent from our failure to rehearing this case en banc."). Judge Smith's chambers are in El Segundo, but this year he's el primero in the 9th Circuit according to the Green Bag. The 9th Circuit has historically fared well in these awards. Congrats to Judge Smith for upholding that fine tradition.

In other news, possibly of interest, see Ruiz v. CSAA, which LACBA's Daily eBriefs summary begins: When the parties to a contract want their agreement to encompass a waiver of the right to appeal from an anticipated judicial ruling, they must say so explicitly and unambiguously.
