"I think sometimes … the two sides stake out very, very polar positions, and there's nothing in the middle, and the court feels maybe understandably a little frustrated because they don't find attractive either extreme," he said. "Advocates can think about [this]: If you were in the position of the court, how might you think about this problem in a way that tries to accommodate a variety of interests?""The court has already thought very seriously about the case, and we have already exchanged views among each other probing the weak points and strong points of the case," Justice Liu told Law360. "Advocates, I think, in that context would especially do well to answer the questions, because they are the real questions that the court has on its mind."
