Law360 has 6th Circ. Says Thin Briefing Tanked Power Co.'s ERISA Appeal:

In an unpublished opinion, a split three-judge panel held that because American Electric Power Service Corp.'s appellate brief didn't address why a lower court erred in concluding it lacked jurisdiction over the matter and dismissing the case, AEP had forfeited its argument on appeal. "Appellants must address in their opening brief the reasons provided by the district court or else risk forfeiting the argument that the district court erred," the panel's majority said. ... Senior U.S. Circuit Judge Ralph B. Guy Jr. dissented from the panel's majority and said in a separate opinion that he disagreed that AEP had forfeited review of whether the probate exception applied to its ERISA claim.
