In today's DJ Appellate Zealots column, Ben Feuer offers When the High Court DIGs Your Dreams, about when SCOTUS dismisses a case as improvidently granted. He describes how this happened in the Visa case because the petitioner changed arguments from the cert petition in the merits briefing. The lesson: "Dance with the one that brung ya."
