California's Constitution requires the Supreme Court's review of clemency grants to those twice-convicted of a felony. My decision to commute all death sentences therefor compel the involvement of the Chief Justice and Associate Justices in a unique inter-branch constitutional process.
So what are the appellate consequences of Gov. Newsom commuting all death sentences? Presumably all of the pending death penalty appeals at the Supreme Court will be sent to the Courts of Appeal to resolve. And perhaps that means greater bandwidth at the Supreme Court to take more cases (especially civil cases)? Can't wait to see what happens!
