LACBA Appellate Courts Program: February 28 (12 noon to 1:00 p.m.) – ICWA in the Highest Appellate Courts. The Indian Child Welfare Act (ICWA) is at issue in the highest courts in the land. The Supreme Court of the United States will decide ICWA’s constitutionality in Haaland v. Brackeen, a case that was argued in November. The Supreme Court of California has granted review in In re Dezi C., presenting the issue of what constitutes reversible error when a child welfare agency fails to make the statutorily required inquiry concerning a child’s potential Indian ancestry.
