DJ profiles J. Kleinfeld

Today's DJ has Open to the Process: 9th Circuit Judge Andrew Kleinfeld is 'more flexible' than many jurists, colleague says.

  • For more than three decades, Kleinfeld's career has been on the 9th Circuit, where he has made a name for himself as a judge that can't easily be categorized. Kleinfeld received two federal judicial appointments from Republican presidents -- President Reagan appointed him to the Alaska District Court in 1986 and President George H.W. Bush elevated him to the 9th Circuit in 1991 -- but says he is most accurately described as a libertarian.
  • Kleinfeld has testified in support of proposals to break up the 9th Circuit. Among his reasons are that the court has "too much power" given its jurisdiction over so much of the nation's population.

The monthly newsletter of The Appellate Project -- The Appellate Review (Nov. 2022) -- reports that TAP has launched its 2022-23 Mentorship Program, welcoming 138 students and 276 mentors. Also, this month TAP students visited the 9th Circuit in Pasadena to watch oral argument and meet with Judges Nguyen, Thomas and Watford.

On November 30 the USC Gould School of Law & LACBA's Business Law Section presents the 2022 Institute for Corporate Counsel, which has two appellate programs of note. First, David Ettinger and Cindy Tobisman will discuss the California Supreme Court; second, Deanne Maynard and Prof. Eugene Volokh will give a US Supreme Court Update.

On December 1 (noon to 1 at the Federal Courthouse), the FBA-Sacramento Chapter presenting a Clerkship Panel that will feature 9th Cir. Judge Callahan and 5th district Court of Appeal Appellate Attorney AJ Wipfler.
