Appellate round up

The D.C. Circuit announces that: "Subject to adjustment as conditions and the latest public health guidance may warrant, the court will resume holding in-person oral arguments on March 30, 2022. All oral arguments prior to that date will proceed remotely by video conference using Zoom for Government. An audio feed from oral arguments will be live-streamed to the public at no cost on the court's YouTube channel, except when sealed material is being discussed."

Today's DJ has PJ Gilbert's Under Submission column, Biased about being biased, wondering if the judiciary is taking concerns about "sensitivity to implicit bias" "too far."

Today's DJ also has Moskovitz on Appeal, Fighting for a 'turnaround' about oral argument preparation and zealous advocacy in the face of what appears to be a losing battle.
