In-person or remote?

Law.com has Another Federal Appeals Court Switches to Remote Arguments Amid Omicron Spike 


The Seventh Circuit is one of two federal appeals courts this week to announce a return to remote oral arguments. [The Federal Circuit is the other one.]

  • In the order published Wednesday, the court said counsel will argue by phone or video through Jan. 31. Proceedings resume in the Chicago-based court on Jan. 5 and audio will continue to be livestreamed on YouTube.
  • Other circuits, including the Tenth, D.C. and Eighth, are weighing whether in-person arguments should be suspended, though no changes have been announced. In those courts, some attorneys scheduled for January appearances have filed requests to argue remotely instead.
