The Juris Lab has posted data on how likely a federal appeal will be invited for oral argument by circuit and case type (Oral Argument Grant Rate in the Federal Court of Appeals (2019 Data)). So for the Ninth Circuit, the data is a 28.6% chance of argument in all appeals, and 43.7% for civil appeals. In contrast, civil appeals will get argument in the 2d Cir. 59.9% of the time (and 65% in the 5th Cir.; 63.4% in the 7th). At the other end of the spectrum, the rate for civil appeals is only 28.4% in the 3d Cir., 28.1% in the 11th and 26.9% in the 4th.
