Second, a milder footnote swipe against a pro-per appellant here (fn. 3 begins: "Appellant's] opening brief on appeal is, to put it mildly, difficult to read and understand.").
Also of note today, the 9th Cir. dissent here, decrying "egregious" "deceit and dishonorable conduct ... unworthy of members of the bar."
