New FRAP, but 9th keeps key rules

New FRAP and Circuit Rules coming December 1

The Federal Rules of Appellate Procedure have been amended, effective December 1, 2016.  The amendments to the rules can be found at: https://www.supremecourt.gov/orders/courtorders/frap16_j92i.pdf

The Ninth Circuit has adopted local rules, effective December 1, 2016, that will maintain the existing word count limits for briefs, and page limits for motions and petitions, rather than adopting the new limits in the revised Federal Rules.  Also please note that Circuit Rule 26-2 will continue to provide the additional 3 days for service by electronic method for those deadlines that are based on service of another document.  The amended Circuit Rules are posted at:
