Today's DJ also features US Supreme Court will consider class certification appellate jurisdiction by Sonya Winner of Covington & Burling, about Microsoft v. Baker:
May a plaintiff whose effort to obtain class action treatment is rejected obtain immediate appellate review of that decision simply by entering a conditional voluntary dismissal of her own claim? Several circuits have answered this question resoundingly in the negative. The 9th U.S. Circuit Court of Appeals has held otherwise, and the Supreme Court will resolve the conflict next term in Microsoft v. Baker, 15-457.
