Sanctions for incomplete CCIS form

SANCTIONS WARNING!

In this unpub from the 5th today, the Court of Appeal imposes $500 sanctions on appellant for failing to check the box in the Civil Case Info Statement indicating that an appeal from an order denying arbitration is entitled to preference:

we find defendant’s attorneys violated the mandatory requirement in Rule 8.100(g)(1) that they “serve and file in the reviewing court a completed Civil Case Information Statement (form APP-004).” (Italics added.) We further find that the violation was unreasonable for purposes of Rule 8.276(a)(4) because defendant’s attorneys were aware of the statute mandating calendar preference in this appeal.
